Contudo, a quest\u00e3o \u00e9 pass\u00edvel de recurso, uma vez que a letra D tamb\u00e9m est\u00e1 correta.<\/p>\n\n\n\n<p>Segundo a Lei 8.112\/1990:<\/p>\n\n\n\n<p>Art. 25.&nbsp;&nbsp;Revers\u00e3o \u00e9 o retorno \u00e0 atividade de servidor aposentado: [&#8230;]<\/p>\n\n\n\n<p>II &#8211; no interesse da administra\u00e7\u00e3o, desde que:<\/p>\n\n\n\n<p>[&#8230;]<\/p>\n\n\n\n<p>d) a aposentadoria tenha ocorrido nos cinco anos anteriores \u00e0 solicita\u00e7\u00e3o;<\/p>\n\n\n\n<p>[&#8230;]<\/p>\n\n\n\n<p>Art.&nbsp;27.&nbsp;&nbsp;N\u00e3o poder\u00e1 reverter o aposentado que j\u00e1 tiver completado 70 (setenta) anos de idade.<\/p>\n\n\n\n<p>Nesse sentido, a letra B realmente est\u00e1 correta, j\u00e1 que Serapi\u00e3o deixou o cargo h\u00e1 mais de cinco anos, n\u00e3o podendo retornar, mediante revers\u00e3o, em raz\u00e3o do previsto no art. 25, \u201cd\u201d, da Lei 8.112\/1990.<\/p>\n\n\n\n<p>Por\u00e9m, ele tamb\u00e9m n\u00e3o poderia retornar em fun\u00e7\u00e3o da idade, j\u00e1 que a lei veda a revers\u00e3o ap\u00f3s o servidor completar 70 anos de idade. Como ele 70 anos em 31 de janeiro de 2025, j\u00e1 n\u00e3o poderia ser revertido em mar\u00e7o do mesmo ano.<\/p>\n\n\n\n<p>Talvez o avaliador tenha realizado confus\u00e3o com a altera\u00e7\u00e3o da idade da aposentadoria compuls\u00f3ria, que foi ampliada para 75 anos com a Emenda Constitucional 88\/2015 (EC88) e a Lei Complementar 152\/2015 (LC152). Contudo, as duas idades n\u00e3o se confundem. A EC88 e a LC152 n\u00e3o fazem qualquer men\u00e7\u00e3o ao texto da Lei 8.112\/1990. Al\u00e9m disso, n\u00e3o h\u00e1 qualquer norma constitucional que obrigue o legislador ordin\u00e1rio a permitir a revers\u00e3o at\u00e9 a idade da aposentadoria compuls\u00f3ria.<\/p>\n\n\n\n<p>Por fim, fazendo uma analogia, a idade para ingressar no cargo de ministro do TCU era de 65 anos, enquanto a aposentadoria compuls\u00f3ria ocorria aos 70 anos.
