AGU, procuradores de Estado, defensores p\u00fablicos, bombeiros militares e policiais<\/p>\n\n\n\n<p><strong>Facultativo <\/strong>(CF, Art. 39, \u00a7 8\u00ba):<strong> <\/strong>servidores p\u00fablicos organizados<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-green-cyan-color\">Vencimentos<\/mark><\/strong>: vencimento + vantagens pecuni\u00e1rias permanentes<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-green-cyan-color\">Sal\u00e1rios<\/mark><\/strong>: \u00e9 a remunera\u00e7\u00e3o dos empregados p\u00fablicos.<\/li>\n<\/ul>\n\n\n\n<p>Quanto \u00e0 <strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-green-cyan-color\">fixa\u00e7\u00e3o e reajuste da remunera\u00e7\u00e3o<\/mark><\/strong>, podemos sintetizar o seguinte:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Regra <\/strong>(CF, Art. 37, X):\u00a0<strong>lei espec\u00edfica<\/strong> de iniciativa de cada poder<\/li>\n\n\n\n<li><strong>Via\u00a0decreto legislativo <\/strong>(CF, Art.49): Presidente da Rep\u00fablica e Vice, Ministros de Estado, Senadores e Deputados Federais;<\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-image aligncenter size-full is-resized\"><img loading=\"lazy\" decoding=\"async\" width=\"886\" height=\"461\" src=\"https:\/\/dhg1h5j42swfq.cloudfront.net\/2024\/08\/22182651\/image-509.png\" alt=\"Remunera\u00e7\u00e3o e Previd\u00eancia para SEFAZ-RJ: Direito Constitucional\" class=\"wp-image-1450008\" style=\"width:614px;height:auto\" srcset=\"https:\/\/dhg1h5j42swfq.cloudfront.net\/2024\/08\/22182651\/image-509.png 886w, https:\/\/dhg1h5j42swfq.cloudfront.net\/2024\/08\/22182651\/image-509-300x156.png 300w, https:\/\/dhg1h5j42swfq.cloudfront.net\/2024\/08\/22182651\/image-509-768x400.png 768w, https:\/\/dhg1h5j42swfq.cloudfront.net\/2024\/08\/22182651\/image-509-610x317.png 610w, https:\/\/dhg1h5j42swfq.cloudfront.net\/2024\/08\/22182651\/image-509-150x78.png 150w\" sizes=\"auto, (max-width: 886px) 100vw, 886px\" \/><\/figure>\n\n\n\n<p>Entretanto, devemos ter em mente a <strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-green-cyan-color\">diferen\u00e7a entre Revis\u00e3o Geral Anual e Revis\u00e3o Setorial<\/mark><\/strong>.<\/p>\n\n\n\n<p>No caso da <mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-purple-color\"><strong>Revis\u00e3o Geral<\/strong> <\/mark>(CF, Art. 37, X), ou seja, a revis\u00e3o que vale para todos os servidores (inclusive de outros poderes) \u00e9 de compet\u00eancia do Poder Executivo, ocorre sempre na mesma data e sem distin\u00e7\u00e3o de \u00edndices;<\/p>\n\n\n\n<p>O n\u00e3o encaminhamento de PL pelo Executivo n\u00e3o gera direito subjetivo a indeniza\u00e7\u00e3o, mas o Executivo deve pronunciar a raz\u00e3o (STF, RE 565089 e RE 843112), al\u00e9m disso, n\u00e3o cabe ao Judici\u00e1rio fixar \u00edndice de corre\u00e7\u00e3o (STF, Tema 624)<\/p>\n\n\n\n<p>J\u00e1 a <strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-purple-color\">Revis\u00e3o Setorial<\/mark><\/strong>, aquela que \u00e9 v\u00e1lida apenas para o \u00f3rg\u00e3o\/poder, \u00e9 de compet\u00eancia do dirigente m\u00e1ximo daquele Poder\/\u00f3rg\u00e3o.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Teto Remunerat\u00f3rio e Acumula\u00e7\u00e3o Remunerada<\/h2>\n\n\n\n<p>Prosseguindo no resumo sobre a Remunera\u00e7\u00e3o e Previd\u00eancia para SEFAZ-RJ, agora vamos tratar sobre o Teto Remunerat\u00f3rio.<\/p>\n\n\n\n<p><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\">Teto Remunerat\u00f3rio<\/mark>: <\/strong>abrange todas as parcelas remunerat\u00f3rias, exceto as de car\u00e1ter indenizat\u00f3rio.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-green-cyan-color\">Teto federal e geral<\/mark><\/strong>: Subs\u00eddio <strong>STF<\/strong><\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-green-cyan-color\">Teto estadual \/ distrital:<\/mark><\/strong><\/li>\n<\/ul>\n\n\n\n<p><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-purple-color\">Legislativo<\/mark>: <\/strong>Subs\u00eddio dos <strong>Dep. Estaduais<\/strong>; \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n\n\n\n<p><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-purple-color\">Executivo<\/mark>: <\/strong>Subs\u00eddio do <strong>Governador<\/strong>, poss\u00edvel ser o do desembargador do TJ (CF, Art. 37, \u00a712\u00ba);<\/p>\n\n\n\n<p><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-purple-color\">Judici\u00e1rio<\/mark>: <\/strong>Subs\u00eddio do <strong>Desembargador do TJ<\/strong> (90,25% do STF, v\u00e1lido MP, Procuradores e DP), (exceto ju\u00edzes, que observam o teto do STF)<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-green-cyan-color\">Teto municipal<\/mark>: <\/strong>Subs\u00eddio do Prefeito, tanto para o executivo quanto para o legislativo (exceto vereadores)<\/li>\n<\/ul>\n\n\n\n<p>Tamb\u00e9m \u00e9 v\u00e1lido recordar que o teto remunerat\u00f3rio \u00e9 v\u00e1lido para Estatais Dependentes (CF, Art. 37, \u00a79\u00ba c\/c LRF, Art.2, III).<\/p>\n\n\n\n<p>Agora vamos tratar sobre a Acumula\u00e7\u00e3o Remunerada de cargos p\u00fablicos, tema que vale inclusive para empregos e fun\u00e7\u00f5es da administra\u00e7\u00e3o indireta (CF, Art. 37, XVII) e militares dos estados (CF, Art. 42 \u00a73\u00ba)<\/p>\n\n\n\n<p><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\">Acumula\u00e7\u00e3o Remunerada de cargos p\u00fablicos<\/mark><\/strong><\/p>\n\n\n\n<p><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-green-cyan-color\">Regra <\/mark><\/strong>(CF, Art. 37, XVI):vedado<\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-green-cyan-color\"><strong>Exce\u00e7\u00f5es<\/strong> <\/mark>(houver compatibilidade de hor\u00e1rios)<br \/>a) professor + professor;<br \/>b) professor + cargo t\u00e9cnico ou cient\u00edfico;<br \/>c) profissional de sa\u00fade + profissional de sa\u00fade<br \/>d) cargo p\u00fablico + Mandato de vereador\u00a0 \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n\n\n\n<p>\u00c9 v\u00e1lido saber que nos casos autorizados constitucionalmente de acumula\u00e7\u00e3o de cargos, o teto remunerat\u00f3rio \u00e9 verificado individualmente e n\u00e3o o somat\u00f3rio dos ganhos do agente p\u00fablico (STF, Temas 337 e 384)<\/p>\n\n\n\n<p>Al\u00e9m disso, \u00e9 poss\u00edvel <strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-purple-color\">acumula\u00e7\u00e3o de proventos de aposentadoria<\/mark> (RPPS)<\/strong> com cargos acumul\u00e1veis, cargos eletivos e cargos em comiss\u00e3o.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Previd\u00eancia<\/h2>\n\n\n\n<p>Para finalizar o resumo sobre a Remunera\u00e7\u00e3o e Previd\u00eancia para SEFAZ-RJ, vamos tratar sobre a Previd\u00eancia.<\/p>\n\n\n\n<p>O RPPS \u00e9 o regime previdenci\u00e1rio destinado a servidores p\u00fablicos efetivos, gerido pelos pr\u00f3prios entes federativos com regras espec\u00edficas. J\u00e1 o RGPS, administrado pelo INSS, abrange trabalhadores da iniciativa privada, aut\u00f4nomos e servidores sem regime pr\u00f3prio, seguindo regras nacionais uniformes.<\/p>\n\n\n\n<p>Assim, vejamos as regras do RPPS.<\/p>\n\n\n\n<p><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\">Regimes Pr\u00f3prios de Previd\u00eancia Social (RPPS)<\/mark><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>V\u00e1lido para <strong>cargos efetivos<\/strong>, assim comissionados, empregado p\u00fablico, mandato eletivo entre outros s\u00e3o RGPS.<\/li>\n\n\n\n<li>Um \u00fanico regime pr\u00f3prio para cada ente (CF, Art. 40, \u00a720\u00ba)<\/li>\n\n\n\n<li>car\u00e1ter <strong>contributivo<\/strong> (respectivo ente, servidores ativos e o que ultrapassar o RGPS para servidores inativos e pensionistas) e <strong>solid\u00e1rio<\/strong> (CF, Art. 40)<\/li>\n<\/ul>\n\n\n\n<p>Assim, conhe\u00e7amos as aposentadorias.<\/p>\n\n\n\n<p><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-green-cyan-color\">Hip\u00f3teses de concess\u00e3o de aposentadoria<\/mark><\/strong> (CF, Art. 40, \u00a71\u00ba)<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Aposentadoria por incapacidade permanente para o trabalho: quando insuscet\u00edvel de readapta\u00e7\u00e3o<\/li>\n\n\n\n<li>Aposentadoria compuls\u00f3ria: 75 anos, exceto para cargo exclusivamente em comiss\u00e3o<\/li>\n\n\n\n<li>Aposentadoria volunt\u00e1ria: homem: 65 anos e mulher 62 anos<\/li>\n<\/ul>\n\n\n\n<p>Atente-se que, em regra, \u00e9 <strong>vedada a ado\u00e7\u00e3o de crit\u00e9rios diferenciados para concess\u00e3o de benef\u00edcios em RPPS<\/strong>, mas existem exce\u00e7\u00f5es (<strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-purple-color\">Aposentadoria Especial<\/mark><\/strong>):<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Servidores com defici\u00eancia (CF, Art. 40, \u00a74\u00ba-A)<\/li>\n\n\n\n<li>Agentes de \u201cseguran\u00e7a\u201d (CF, Art. 40, \u00a74\u00ba-b)<\/li>\n\n\n\n<li>Atividades com \u201cpericulosidade\u201d (CF, Art. 40, \u00a74\u00ba-c)<\/li>\n\n\n\n<li>Professores a educa\u00e7\u00e3o infantil e no ensino fundamental e m\u00e9dio fixado: 5 anos a menos (CF, Art. 40, \u00a75\u00ba)<\/li>\n<\/ul>\n\n\n\n<p>Al\u00e9m disso, a CF os Limites para aposentadoria (CF, Art. 40, \u00a72\u00ba), sendo o limite inferior o sal\u00e1rio-m\u00ednimo e o teto o pr\u00f3prio RGPS.<\/p>\n\n\n\n<p>Vale ressaltar que que atualmente os entes s\u00e3o obrigados a instituir, por meio de lei do poder executivo, o <strong>regime complementar de aposentadoria<\/strong> (CF, Art. 40, \u00a714\u00ba)<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Considera\u00e7\u00f5es Finais<\/h2>\n\n\n\n<p>Pessoal, chegamos ao final do Remunera\u00e7\u00e3o e Previd\u00eancia para SEFAZ-RJ.<\/p>\n\n\n\n<p>Obviamente tratamos apenas os aspectos principais do tema, assim n\u00e3o deixe de estudar o assunto na \u00edntegra por nossas aulas, al\u00e9m de treinar por meio de quest\u00f5es de concurso em nosso <a href=\"https:\/\/www.estrategiaconcursos.com.br\/cursosPorConcurso\/sistema-de-questoes\/\">sistema de quest\u00f5es<\/a>.<\/p>\n\n\n\n<p>Gostou do artigo?
