No estado de S\u00e3o Paulo, quando o funcion\u00e1rio estadual, por motivo de <strong>sa\u00fade<\/strong>, estiver impossibilitado para o exerc\u00edcio do cargo, ele ter\u00e1 direito \u00e0 licen\u00e7a para tratamento, concedida at\u00e9 o <strong>m\u00e1ximo <\/strong>de <strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\">4 anos<\/mark><\/strong>, <strong>com vencimento <\/strong>ou remunera\u00e7\u00e3o.<\/p>\n\n\n\n<p>Ap\u00f3s o prazo da licen\u00e7a, o funcion\u00e1rio ser\u00e1 submetido \u00e0 <strong>inspe\u00e7\u00e3o m\u00e9dica<\/strong>. Caso seja verificada sua <strong>invalidez<\/strong>, o funcion\u00e1rio ser\u00e1 <strong>aposentado<\/strong>. Contudo, caso <strong>n\u00e3o <\/strong>justifique a aposentadoria, permite-se o licenciamento <strong>al\u00e9m do prazo<\/strong> citado.<\/p>\n\n\n\n<p><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">A SABER:<\/mark>&nbsp;<\/strong>O funcion\u00e1rio ocupante de cargo em <strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\">comiss\u00e3o <\/mark><\/strong>tamb\u00e9m poder\u00e1 ser <strong>aposentado<\/strong>, nas condi\u00e7\u00f5es acima.<\/p>\n\n\n\n<p>A licen\u00e7a para tratamento de sa\u00fade depender\u00e1 de inspe\u00e7\u00e3o m\u00e9dica oficial e poder\u00e1 ser concedida&nbsp;<strong>a pedido<\/strong> do funcion\u00e1rio ou <strong>\u201cex officio<\/strong>\u201d.<\/p>\n\n\n\n<p>Contudo, a <strong>inspe\u00e7\u00e3o<\/strong> <strong>m\u00e9dica<\/strong> poder\u00e1 ser <strong>dispensada<\/strong>, a crit\u00e9rio do \u00f3rg\u00e3o oficial, quando a<strong> an\u00e1lise documental<\/strong> for <strong>suficiente <\/strong>para comprovar a incapacidade laboral.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-licenca-ao-funcionario-acidentado-no-exercicio-de-suas-atribuicoes-ou-atacado-de-doenca-profissional\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\">Licen\u00e7a ao Funcion\u00e1rio Acidentado no Exerc\u00edcio de suas Atribui\u00e7\u00f5es ou Atacado de Doen\u00e7a Profissional<\/mark><\/h2>\n\n\n\n<p>Essa licen\u00e7a \u00e9 concedida ao funcion\u00e1rio <strong>acidentado <\/strong>no <strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\">exerc\u00edcio de suas atribui\u00e7\u00f5es<\/mark><\/strong> ou que tenha adquirido <strong>doen\u00e7a profissional<\/strong>, com <strong>vencimento <\/strong>ou remunera\u00e7\u00e3o, n\u00e3o podendo exceder a <strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\">4 anos<\/mark><\/strong>.<\/p>\n\n\n\n<p>Contudo, no caso de acidente, verificada a<strong> incapacidade total<\/strong> para qualquer fun\u00e7\u00e3o p\u00fablica, ser\u00e1 <strong>desde logo <\/strong>concedida <strong>aposentadoria <\/strong>ao funcion\u00e1rio.<\/p>\n\n\n\n<p>O estatuto ainda disp\u00f5e expressamente sobre algumas situa\u00e7\u00f5es que s\u00e3o tamb\u00e9m <strong>consideradas acidente<\/strong>, como a <strong>agress\u00e3o <\/strong>sofrida e <strong>n\u00e3o provocada<\/strong> pelo funcion\u00e1rio, no <strong>exerc\u00edcio<\/strong> de suas fun\u00e7\u00f5es; e a <strong>les\u00e3o <\/strong>sofrida pelo funcion\u00e1rio, quando <strong>em tr\u00e2nsito,<\/strong> no percurso usual <strong>para o trabalho<\/strong>.<\/p>\n\n\n\n<p>A <strong>comprova\u00e7\u00e3o do acidente<\/strong>, indispens\u00e1vel para a concess\u00e3o da licen\u00e7a, ser\u00e1 feita em procedimento pr\u00f3prio, que dever\u00e1 se iniciar no prazo de <strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\">10 dias<\/mark><\/strong>, contados da data do acidente.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-licenca-a-funcionaria-gestante\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\">Licen\u00e7a \u00e0 Funcion\u00e1ria Gestante<\/mark><\/h2>\n\n\n\n<p>Esta \u00e9 uma das licen\u00e7as mais <strong>importantes<\/strong>, visto que permite que a m\u00e3e esteja junto do seu filho durante os primeiros dias de nascimento ou de ado\u00e7\u00e3o.<\/p>\n\n\n\n<p>\u00c0 funcion\u00e1ria gestante ser\u00e1 concedida licen\u00e7a de <strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\">180 dias<\/mark><\/strong>, <strong>com vencimento <\/strong>ou remunera\u00e7\u00e3o, observado o seguinte:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>a licen\u00e7a <strong>poder\u00e1<\/strong> ser concedida a partir da <strong>32\u00aa semana<\/strong> de gesta\u00e7\u00e3o, mediante documenta\u00e7\u00e3o m\u00e9dica que comprove a gravidez e a respectiva idade gestacional;<\/li><li>ocorrido o <strong>parto<\/strong>, sem que tenha sido requerida a licen\u00e7a, ser\u00e1 esta concedida mediante a apresenta\u00e7\u00e3o da<strong> certid\u00e3o de nascimento<\/strong> e vigorar\u00e1 a partir da <strong>data do evento<\/strong>, podendo <strong>retroagir<\/strong> <strong>at\u00e9 15 dias<\/strong>;<\/li><li>durante a licen\u00e7a, comete <strong>falta grave<\/strong> a servidora que <strong>exercer <\/strong>qualquer <strong>atividade remunerada<\/strong> ou mantiver a crian\u00e7a em <strong>creche <\/strong>ou organiza\u00e7\u00e3o similar.<\/li><\/ul>\n\n\n\n<p><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">A SABER: <\/mark><\/strong>No caso de <strong>natimorto<\/strong>, ser\u00e1 concedida a licen\u00e7a para<strong> tratamento de sa\u00fade,<\/strong> a crit\u00e9rio m\u00e9dico.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-licenca-por-motivo-de-doenca-em-pessoa-da-familia\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\">Licen\u00e7a por Motivo de Doen\u00e7a em Pessoa da Fam\u00edlia<\/mark><\/h2>\n\n\n\n<p>N\u00e3o \u00e9 apenas quando a sa\u00fade do funcion\u00e1rio p\u00fablico est\u00e1 debilitada que ele possui direito \u00e0 licen\u00e7a.<\/p>\n\n\n\n<p>Quando o<strong> c\u00f4njuge <\/strong>ou de <strong>parentes at\u00e9 segundo grau <\/strong>do servidor<strong>&nbsp;<\/strong>estiver doente, o funcion\u00e1rio tamb\u00e9m poder\u00e1 se licenciar.<\/p>\n\n\n\n<p>Esta licen\u00e7a ser\u00e1 concedida <strong>com vencimentos<\/strong> ou remunera\u00e7\u00e3o <strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\">at\u00e9 1 m\u00eas<\/mark><\/strong> e com os seguintes <strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\">descontos<\/mark><\/strong>:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>de <strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\">1\/3<\/mark><\/strong>, quando <strong>exceder <\/strong>a <strong>1 m\u00eas at\u00e9 3<\/strong>;<\/li><li>de <strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\">2\/3<\/mark><\/strong>, quando <strong>exceder<\/strong> a <strong>3 at\u00e9 6<\/strong>;<\/li><li><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\">sem vencimento<\/mark> <\/strong>ou remunera\u00e7\u00e3o do <strong>s\u00e9timo ao vig\u00e9simo m\u00eas<\/strong>.<\/li><\/ul>\n\n\n\n<p>Por fim, ser\u00e3o <strong>somadas <\/strong>as licen\u00e7as concedidas durante o per\u00edodo de <strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\">20 meses<\/mark><\/strong>, contado da primeira concess\u00e3o.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-licenca-para-atender-a-obrigacoes-concernentes-ao-servico-militar\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\">Licen\u00e7a para Atender a Obriga\u00e7\u00f5es Concernentes ao Servi\u00e7o Militar<\/mark><\/h2>\n\n\n\n<p>O funcion\u00e1rio que for convocado para o<strong> servi\u00e7o militar<\/strong> e outros encargos da <strong>seguran\u00e7a naciona<\/strong>l ter\u00e1 direito \u00e0 licen\u00e7a, contudo,<strong> sem vencimento<\/strong> ou remunera\u00e7\u00e3o.<\/p>\n\n\n\n<p>Ap\u00f3s o <strong>fim <\/strong>da licen\u00e7a, o funcion\u00e1rio desincorporado<strong> reassumir\u00e1 imediatamente <\/strong>o exerc\u00edcio, sob pena de <strong>demiss\u00e3o<\/strong> por inassiduidade, se a aus\u00eancia <strong>exceder<\/strong> <strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\">15 dias<\/mark><\/strong> <strong>consecutivos<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-licenca-para-tratar-de-interesses-particulares\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\">Licen\u00e7a para Tratar de Interesses Particulares<\/mark><\/h2>\n\n\n\n<p>Quando surgir algum&nbsp;<strong>imprevisto na vida pessoal&nbsp;<\/strong>do servidor, ele poder\u00e1 solicitar uma licen\u00e7a, de modo a tratar dos seus&nbsp;<strong>interesses particulares<\/strong>.<\/p>\n\n\n\n<p>Contudo, ela n\u00e3o poder\u00e1 ser concedida livremente, sendo necess\u00e1rio que o poder p\u00fablico, ap\u00f3s avaliada a situa\u00e7\u00e3o,<strong>&nbsp;discricionariamente a&nbsp;conceda<\/strong>, podendo ser <strong>negada <\/strong>a licen\u00e7a quando o afastamento do funcion\u00e1rio for <strong>inconveniente ao interesse do servi\u00e7o<\/strong>.<\/p>\n\n\n\n<p><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">A SABER: <\/mark><\/strong>Tal licen\u00e7a apenas poder\u00e1 ser concedida <strong>depois <\/strong>de <strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\">5 anos de exerc\u00edcio<\/mark><\/strong>, <strong>sem vencimento<\/strong> ou remunera\u00e7\u00e3o, pelo prazo <strong>m\u00e1ximo<\/strong> de <strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\">2 anos<\/mark><\/strong>.<\/p>\n\n\n\n<p>Al\u00e9m disso, a licen\u00e7a poder\u00e1 ser gozada <strong>parceladamente <\/strong>a ju\u00edzo da Administra\u00e7\u00e3o, desde que dentro do per\u00edodo de <strong>3 anos<\/strong>, sendo que s\u00f3 poder\u00e1 ser concedida <strong>nova licen\u00e7a <\/strong>depois de decorridos<strong> 5 anos<\/strong> do <strong>t\u00e9rmino da anterior.<\/strong><\/p>\n\n\n\n<p>Vale ainda salientar que <strong>n\u00e3o <\/strong>ser\u00e1 concedida licen\u00e7a para tratar de interesses particulares ao funcion\u00e1rio nomeado, removido ou transferido, <strong>antes <\/strong>de <strong>assumir o exerc\u00edcio <\/strong>do cargo.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-licenca-a-funcionaria-casada-com-funcionario-ou-militar\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\">Licen\u00e7a \u00e0 Funcion\u00e1ria Casada com Funcion\u00e1rio ou Militar<\/mark><\/h2>\n\n\n\n<p>Esta \u00e9 uma licen\u00e7a que permite que a <strong>funcion\u00e1ria <\/strong>estadual <strong>acompanhe <\/strong>o seu <strong>c\u00f4njuge<\/strong>, tamb\u00e9m <strong>funcion\u00e1rio<\/strong>, em eventual<strong> mudan\u00e7a de domic\u00edlio<\/strong>.<\/p>\n\n\n\n<p>Nesse sentido, a funcion\u00e1ria casada com funcion\u00e1rio estadual ou com militar ter\u00e1 direito \u00e0 licen\u00e7a, <strong>sem vencimento <\/strong>ou remunera\u00e7\u00e3o, quando o marido for mandado <strong>servir<\/strong>, <strong>independentemente de solicita\u00e7\u00e3o<\/strong>, em <strong>outro ponto do Estado<\/strong> ou do <strong>territ\u00f3rio nacional <\/strong>ou no <strong>estrangeiro<\/strong>.<\/p>\n\n\n\n<p>N\u00e3o h\u00e1 um limite m\u00e1ximo para esta licen\u00e7a, j\u00e1 que ela vigorar\u00e1 pelo <strong>tempo <\/strong>que <strong>durar <\/strong>a comiss\u00e3o ou a nova fun\u00e7\u00e3o do marido.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-licenca-compulsoria\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\">Licen\u00e7a Compuls\u00f3ria<\/mark><\/h2>\n\n\n\n<p>Quando o funcion\u00e1rio for considerado <strong>fonte <\/strong>de <strong>infec\u00e7\u00e3o <\/strong>de <strong>doen\u00e7a transmiss\u00edvel,<\/strong> ele poder\u00e1 ser licenciado, enquanto <strong>durar essa condi\u00e7\u00e3o<\/strong>, a ju\u00edzo de autoridade sanit\u00e1ria competente, sendo que, quando for <strong>verificada <\/strong>a proced\u00eancia da <strong>suspeita<\/strong>, o funcion\u00e1rio ser\u00e1 licenciado para <strong>tratamento de sa\u00fade.<\/strong><\/p>\n\n\n\n<p>Quando <strong>n\u00e3o positivada<\/strong> a mol\u00e9stia, dever\u00e1 o funcion\u00e1rio <strong>retornar <\/strong>ao servi\u00e7o, durante a pandemia de COVID-19.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-licenca-premio\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color Contudo, para usufru\u00ed-la, \u00e9 necess\u00e1rio que o funcion\u00e1rio <strong>n\u00e3o <\/strong>tenha sofrido qualquer <strong>penalidade administrativa<\/strong>.<\/p>\n\n\n\n<p>O per\u00edodo da licen\u00e7a ser\u00e1 considerado de <strong>efetivo exerc\u00edcio <\/strong>para todos os efeitos legais, e n\u00e3o acarretar\u00e1 desconto algum no vencimento ou remunera\u00e7\u00e3o.<\/p>\n\n\n\n<p>H\u00e1 ainda algumas regras em rela\u00e7\u00e3o a essa licen\u00e7a, j\u00e1 que o funcion\u00e1rio poder\u00e1 requerer o gozo da licen\u00e7a-pr\u00eamio:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>por <strong>inteiro <\/strong>ou em <strong>parcelas <\/strong>n\u00e3o inferiores a <strong>15 dias<\/strong>;<\/li><li>at\u00e9 o implemento das condi\u00e7\u00f5es para a aposentadoria volunt\u00e1ria.<\/li><\/ul>\n\n\n\n<p>Caso o funcion\u00e1rio apresente o pedido de <strong>aposentadoria<\/strong>, <strong>sem <\/strong>a pr\u00e9via e oportuna apresenta\u00e7\u00e3o do <strong>requerimento <\/strong>de gozo da <strong>licen\u00e7a-pr\u00eamio<\/strong>, implicar\u00e1 <strong>perda <\/strong>do direito \u00e0 tal licen\u00e7a.<\/p>\n\n\n\n<p>Ap\u00f3s o funcion\u00e1rio solicitar a licen\u00e7a, ele dever\u00e1 <strong>aguardar em exerc\u00edcio<\/strong> a aprecia\u00e7\u00e3o do requerimento de gozo da licen\u00e7a-pr\u00eamio.
